LIVE IN IT TO WIN IT CONTEST RULES

No purchase necessary. To enter, head to www.k97.ca and fill out the Contest Application. Four “Official Qualifiers” will be selected from all entries on Wednesday, October 28th.

The Contest is open to all residents of Alberta, who are of the age of majority, excluding employees of K-97 FM, Newcap Inc. (“Newcap”), Newcap’s direct and indirect parents, subsidiaries and affiliates, Newcap’s advertising and promotional agencies, participating sponsors and any persons residing in their respective households. K-97 FM and Newcap Inc. are hereafter collectively referred to as “K-97 FM”.

There is no limit on the number of "Official Qualifiers" applicants, each of whom must submit their Contest Application during the entry period which is from 7 am (Alberta time) on Friday, October 2nd 2009 to 5 pm (Alberta time) on Wednesday, October 21st, 2009. Each applicant must fill out the Contest Application at www.k97.ca and submit it to win@k97.ca, fax it to 780- 435-0844 or hand deliver it to K-97 FM at 2394 West Edmonton Mall, 8882-170 Street, Edmonton, AB, T5T 4M2. Contest Applications must not be submitted by postal mail.

Those Official Qualifier applicants as K-97 FM or any judges it may appoint from time to time (“judges”), in their sole discretion, determine will be called in for an interview at a time selected by K-97 FM from Thursday, October 22nd until Wednesday, October 28th 2009. The decision by K-97 FM or its judges as to the selection of the four Official Qualifiers will be based solely on the interviews and the submitted Contest Applications.

In order to become one of the “Official Qualifiers”, the selected entrants must first have correctly answered, unaided, a time limited, mathematical skill testing question posed at the time of the interview. Each Official Qualifier will be required to sign a release and waiver form provided by K-97 FM before participating in the contest, and agree in any event that Contest participation will or may be filmed, videotaped, played live or streamed on the air or the Internet. In any event, each applicant and participant consents to the use of his/her entry, name, and city of residence, likeness and/or photograph in any publicity carried out by K-97 FM and/or its advertising agencies, without compensation.

On Sunday, November 1st at 4pm (Alberta Time), four Official Qualifiers will enter the Contest truck, and the last remaining Official Qualifier in the truck wins the contest. Official Qualifiers can remove themselves from the Contest at any time or may be removed by K-97 FM or the judges at any time if any rules are broken or if K-97 FM or the judges consider, in their sole discretion, that such removal is necessary or desirable to protect the health or welfare of any one or more of the Official Qualifiers.

If more then one Official Qualifier remains in the truck on Friday, November 13th at 4:15pm (Alberta Time), the name of each such remaining Official Qualifier will be entered in a random draw to be held on or about Friday, November 13th at 4:30pm and the first name drawn will win the contest.

The chances of becoming the Contest winner are dependent on the selection and other processes described in these Rules, and will depend in part on the number of persons applying to participate in the Contest.

The winning Official Qualifier will be awarded the prize, which is a 2000 Chevy Silverado courtesy of Cars RV & Marine, complete with a new paint job from Maaco, new canopy and chrome from The Truck Outfitters and new tires and ribs from Dollartire, with an approximate retail value of $15,000.00 CDN. The prize must be accepted as awarded, provided however that K-97 FM may substitute a prize of equal or greater value in its discretion. Prior to being awarded the prize, the winning Official Qualifier will be required to sign a release and waiver provided by K-97 FM. It is understood that the Released Parties (as defined later in these Rules) have not made any warranty, representation, or guarantee, expressed or implied, including but not limited to any
warranty of merchantability or fitness for a particular purpose, regarding the prize, or any substitute prize.

Decisions and rulings of K-97 FM and/or the judges are final and without appeal in all matters.

All applicants and contestants must abide by all Contest Rules announced from time to time by K-97 FM.

During the Contest, physical or verbal abuse, discharge of bodily fluid within the truck or any illegal or unhygienic acts by any Official Qualifier, will not be tolerated – immediate disqualification will result from any such actions. There will be a 5-minute washroom and water break once every three hours. Food will be supplied with 3 meals a day and snacks will be provided throughout the day.

K-97 FM can add, remove or modify rules at any time throughout the Contest and may cancel the Contest at any time, in each case without notice.

K-97 FM is not responsible for any injuries or physical damage that may occur during the Contest.

This event will be recorded via Web Cam and will be available to the public 24 hours a day, 7 days a week.

All Contest applications and entries become the property of K-97 FM which assumes no responsibility for late, lost, stolen, delayed, damaged or misdirected applications or entries or for failure of the K-97 FM website at any time or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from downloading or using any Contest or other material. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest is a violation of laws.

All applications and entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the Contest rules may be disqualified by K-97 FM. K-97 FM takes no responsibility for lost, misdirected, late or destroyed applications or entries, or for typographical or other production errors.

K-97 FM is collecting personal data about applicants and participants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the applicant or participant unless he/she provides K-97 FM with explicit permission to do so as indicated on the application form or other Contest document, or as may otherwise be permitted by applicable laws.

This Contest is subject to all applicable laws.

By applying to enter, or participating in the Contest, each applicant and each participant confirms that he/she has read and understood, and is bound by, these Rules and the decisions of K-97 FM and the judges.

In consideration of the right to apply to participate in the Contest, each applicant agrees to release and indemnify K-97 FM, its direct and indirect parents, subsidiaries and affiliates and each of their officers, directors, employees and contractors (the "Released Parties"), from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of application to participate in, and participation in, in the Contest and from the awarding of, and any use of, the Contest prize. The rights of K-97 FM under these Rules will not be prejudiced or restricted by any waiver extended to an applicant or participant and no waiver by K-97 FM of any breach of these rules will operate as a waiver in respect of any subsequent breach.

Any claim or dispute with respect to the Contest or the Prize shall be governed by Alberta law and any proceedings in relation to any such claim or dispute shall be resolved exclusively by Alberta courts. If any portion of these Rules is determined to be unenforceable by a court of law, all other parts of these Rules shall remain in full force and effect, and these Rules shall be binding on the heirs and assigns of all applicants and participants.
